Yeh, I had a booking with her on a Perth visit, she asked for a deposit. I asked how certain was her trip as she has a reputation of cancelling trips at the last minute.. (that's not an ethical approach). Sure enough she cancelled, no refunds were offered only another booking on her next visit whenever that may be. That's sad to hear. If the provider cancels the date and keeps the deposit then that's simply theft. Doesn't even matter what their TOS says because no real business would be able to reneg on their side of the deal and legally have the right to keep the deposit.

You wanna add something to that or will I? The article is very customer focused in regards to initiating the refund as it doesn't seem to cover change of mind by the business.

 

Basically the cake baker buying ingredients would be an escort booking a hotel and flight in this situation. If the escort cancels these in advance (so they either haven't paid or they got a refund themselves) then there's no fair reason to keep the deposit. They've made a profit without really doing or providing anything. 

 

In this case CMQ is offering you the equivalent of store credit in return, which is usually an OK enough recompense (but worse than cash of course). The problem is you would either have to pay to fly to her or pay extra to fly her to you to take advantage of it. While it's possible she may never tour in Perth again if she chooses not to. And even if she does, it won't be on a time of your choice. 

 

So there's a little bit of cover there and I know a lot of the girls write that into their adds/websites for this reason. But I'd certainly expect to win in court due how absolutely loaded everything is in their favor. It's not reasonable to bait people into sending you non-refundable deposits, spend zero investment into the would be service and then make it utterly impractical to settle the transaction.
